Terms of Service

These Terms of Service ("Terms") govern your use of KineticCopy™, a WordPress plugin operated by KineticBrain™ ("we", "us", "our"). KineticCopy is available at copy.kineticbrain.ai and is part of the KineticBrain product suite.

By purchasing, installing, or using KineticCopy, you agree to be bound by these Terms. If you do not agree, do not use the plugin.

1. Eligibility

You must be at least 16 years old to use KineticCopy. If you are using the plugin on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

2. The Service

2.1 What KineticCopy Does

KineticCopy is a WordPress plugin that uses AI to generate written content in your brand voice. It scans your existing published posts to build a voice model, then generates new content using the Anthropic Claude API. The plugin runs inside your WordPress installation on your own server.

2.2 AI-Generated Content

Content generated by KineticCopy is produced by AI (Anthropic Claude). While we design our prompts for quality and brand accuracy, AI output may contain errors, inaccuracies, or content that does not perfectly match your intended voice. You are responsible for reviewing and editing all generated content before publishing.

2.3 Third-Party AI Provider

KineticCopy uses the Anthropic Claude API to generate content. When you use the plugin, your content prompts and site data are sent to Anthropic for processing. Anthropic's API terms apply to that processing. Anthropic does not use API data to train its models.

3. Licensing and Access

3.1 License Types

KineticCopy is available as:

• Annual subscription: Renewable yearly. Access continues as long as your subscription is active.
• Lifetime Deal (LTD): One-time purchase granting perpetual access to the plugin version available at the time of purchase, plus all future updates for the lifetime of the product.
• Free tier: Limited functionality with no payment required.

3.2 License Scope

Each license tier specifies the number of WordPress sites on which you may activate KineticCopy (1 site for Solo, 3 for Studio, 25 for Agency, unlimited for Enterprise). You may not share your license key with others or use it on more sites than your tier allows.

3.3 License Validation

KineticCopy validates your license via our licensing server at licensing.kineticbrain.ai. The plugin caches your license status locally for up to 72 hours to ensure functionality during temporary connectivity issues.

4. Bring Your Own Key (BYOK)

4.1 Your API Key, Your Responsibility

KineticCopy supports Bring Your Own Key (BYOK), allowing you to use your own Anthropic Claude API key for content generation. When using BYOK:

• You are responsible for your own API usage and costs with Anthropic.
• You must maintain sufficient credit balance with Anthropic.
• You are responsible for setting appropriate usage limits and budget caps in your Anthropic console.
• KineticBrain™ has no control over and accepts no liability for charges incurred on your Anthropic account.

4.2 Key Storage

Your API key is stored in your WordPress database on your own server. It is encrypted at rest. We never transmit your API key to our servers - it is sent directly from your WordPress installation to Anthropic's API.

5. Credits

5.1 Credit System

KineticCopy includes a credit system for users who prefer not to set up their own API key. Credits are consumed when generating content. Credit costs per action are published on our website and in the plugin.

5.2 Credit Purchases

Credits can be purchased as one-time top-up packs, monthly subscriptions, or special packs (such as AppSumo LTD mega packs). All credit purchases are processed through Stripe.

5.3 BYOK Overrides Credits

If you have configured a valid BYOK API key, no credits are consumed for content generation. Your credit balance is preserved as a fallback.

5.4 Credit Expiry

Starter credits and purchased credits do not expire as long as your account is active. Monthly subscription credits are delivered on the 1st of each month and do not roll over.

6. Payment and Refunds

6.1 Payment Processing

All payments are processed by Stripe. We do not store your full payment card details. Stripe processes and stores payment data as an independent data controller.

6.2 Refund Policy

We offer a 14-day money-back guarantee on all license purchases. If KineticCopy does not meet your expectations, email us at [email protected] within 14 days of purchase for a full refund. Credit pack purchases are non-refundable once credits have been used.

6.3 Subscription Cancellation

You may cancel your annual subscription or monthly credit subscription at any time. Cancellation takes effect at the end of your current billing period. No partial refunds are issued for the remaining period.

7. Intellectual Property

7.1 Your Content

You retain full ownership of all content generated using KineticCopy. We claim no rights to your generated content, your source material, or your voice model data.

7.2 Our Software

KineticCopy, including its code, design, prompts, and documentation, is the intellectual property of KineticBrain™. Your license grants you the right to use the plugin, not to redistribute, reverse-engineer, or modify its source code.

8. Acceptable Use

You agree not to use KineticCopy to:

• Generate content that is illegal, defamatory, or infringes on third-party rights
• Produce spam, misleading content, or content designed to deceive
• Attempt to circumvent license restrictions or credit limits
• Reverse-engineer, decompile, or extract the plugin's source code
• Resell or redistribute the plugin or generated content as a competing service
• Overload our licensing servers or attempt to bypass license validation

9. Site Intelligence and Data Processing

9.1 Site Scanning

KineticCopy's Site Intelligence feature scans your published WordPress posts to build a voice model. This scanning happens on your server and sends post content to the Anthropic Claude API for analysis. Free users can scan up to 10 posts; paid users can scan up to 200 posts.

9.2 Data Stays on Your Server

Your voice model, content, and plugin settings are stored in your WordPress database on your own server. We do not have access to your WordPress installation or your generated content.

10. KineticLaunch Integration

KineticCopy can optionally integrate with KineticLaunch™ to receive brand strategy data and calendar briefs. This integration is optional and requires a separate KineticLaunch account. Data shared between the two products is governed by each product's respective terms.

11. Availability and Support

11.1 Availability

KineticCopy is a WordPress plugin that runs on your server. Its availability depends on your hosting environment. Our licensing server maintains 99.9% uptime, and the plugin caches license status locally for resilience.

11.2 Support

Support is available via email at [email protected]. Response times vary by tier: email support for Solo and Studio, priority support for Agency, dedicated support channel for Enterprise.

12. Limitation of Liability

To the maximum extent permitted by law:

• KineticBrain™ is not liable for any indirect, incidental, or consequential damages arising from your use of KineticCopy.
• Our total liability is limited to the amount you paid for KineticCopy in the 12 months preceding the claim.
• We are not responsible for costs incurred on your Anthropic account when using BYOK.
• We are not responsible for the accuracy, legality, or suitability of AI-generated content. You are solely responsible for reviewing and publishing content.

13. Termination

We may suspend or terminate your license if you violate these Terms. Upon termination, you must uninstall KineticCopy from all WordPress sites. Your generated content remains yours and is not affected by termination.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by email or in-plugin notice. Continued use after a change constitutes acceptance.

15. Governing Law

These Terms are governed by the laws of Denmark. Any disputes shall be resolved in the courts of Denmark. This does not affect your statutory rights as a consumer under EU law, including the right to bring proceedings in your country of residence.
